Studies indicate the cascading effect of unemployment in societies in the form of poverty, increased crime rates and suicide rates, and concerns over the mental and physical health of the individual. This also puts a strain on public resources. There’s a need for a more equitable, harmonic and inclusive strategy for addressing unemployment nationwide highlighted by the Apex Court’s continuing scrutiny of these state-specific reservation laws, which highlights the potential for constitutional and economic conflicts."

On the face of it, Remission may look like a straitjacket legal concept, but the overlapping threads of punishment and redemption weaved together make its understanding convoluted. In the case of India, the State derives such power from both the constitutional authority as well as legislative authority.

In this blog authored by Pranav Gupta & Kavya Mittal, 2nd-year law students at @rgnulpunjab, the authors seek to analyse the existing problems in the current Remission system, which range from lack of uniformity on the grounds of the same and the unreasonable discretion enjoyed by the Indian judiciary. With various loopholes and natural “escape mechanisms” contrary to its object and intent, it creates many safe exit routes for the parliamentarians to defect without being held accountable. It has sparked a debate around whether it has been over-exploited to the extent to be scrapped entirely or amended to check the mischief of defection.

In this blog, the authors present a constructive critique of the anti-defection law, highlighting the inadequacies of the Tenth Schedule and the potential solutions aimed at curbing the menace of defection. The judgment passed recently by the Supreme Court in India holding same-sex marriage to be bereft of legal validity has evoked wide-scale discussion and has brought to the forefront the challenges associated with societal and legal change. The present article takes up this judgment for detailed analysis and brings in significant developments at the state level, such as the “Deed of Familial Association” proposed by the Madras High Court, and juxtaposes these against the legal landscapes in the United States and the United Kingdom."
